Week 2 Questions
Question#1
Typically, an arrest warrant is a written authorization granted to a law enforcement
officer by a judge in a court of law allowing the enforcement official the ability and right to put
into custody an individual regarding a crime. On the other hand, a search warrant provides
detailed information on where and when law enforcement officers can search and specifies what
they are to search regarding the occurrence of a crime. Arrest and search warrants have a vital
role in the criminal investigation process (Ouwerkerk 104). Essentially, arrest and search
warrants protect persons from being manipulated by law enforcement officials and the
government.
Under some circumstances, there is a chance that a person may be subjected to
unreasonable search or arrest. The law clearly outlines that a defendant is innocent until is
proven guilty by the court, thus it is important to protect the rights of the accused by the use of
arrest and search warrants. The basic role of an arrest warrant is that it defines the crime the
defendant is involved in. Reasons, why one may be issued an arrest warrant, include suspect
involvement in cases like rape, murder, theft, abduction, smuggling, or breaking (Ouwerkerk
105-109). Arrest and search warrants are written orders from the court of law indicating that

there is a probable cause for arrest or the person has a conflict of interest in a crime and the
documents protect the rights of the suspect from being arrested until proven guilty by the court of
law.
Question#2
The exclusionary rules are sets of rules developed by judges and evidence collected by
the government under circumstances that law enforcement officers violate constitutional rights of
the defendant. Adopted by courts in the United States, the exclusionary rule plays a major role in
preventing government agents and police officers from abusing rights stipulated in the United
States Constitution. The rule applies to evidence of crimes arising from the violation of the
constitution by government officials (Turner, Jenia, and Thomas 33). Exclusionary rules are also
put in place to deter government and law enforcement officials from excluding vital evidence
from the trial process to interfere with the trial process.
The exclusionary rule has generated a great impact on criminal investigations and
criminal justice processes since its introduction in the United States' constitution. The rule is
against suppressing physical evidence like illegal drugs, a weapon for murder, or stolen items by
a government official in interference so that the defendant may not be exposed to unreasonable
arrest or searches (Turner, Jenia and Thomas 44). Another effect of the exclusionary rule is the
provision of room for the state to find truth by safeguarding physical evidence. Since its
introduction, the exclusionary rule has upheld judicial integrity by maintaining dignity and a
strong reputation. Moreover, the rule has not only deterred police misconduct but also allowed
states to show consideration to human rights.
