There always arise a misunderstanding when technological devices designated for
operations at the workplace are used for personal use. In this case, the HR handbook has made it
clear that employees are not allowed to use company computers for social media use. Therefore,
the employer is not liable for any breach of privacy from Jamal’s social media accounts. In the
case of termination of Jamal’s contract, he is supposed to return the computer to the company.
The HR has the right to access what is in the computer including Jamal’s social media accounts
because it’s a workplace property. Putting the restriction in writing protects the employer from
being liable to the law if Jamal uses workplace computers for criminal behavior, copyright
infractions and breaching privacy laws. On the other hand, Jamal is liable for protecting the
company details from the internet considering he is linking his personal details to the workplace
computer. In case of any leakage of company’s data, Jamal is held liable. Jamal is also liable to
the law, on behalf of the company, if he uses the computer for copyright infractions or criminal
behavior because he is bleaching the companies policies. For employer safety, Rustad (2004)
suggests that employers should monitor closely the usage of workplace computers by employees
to access their social media accounts.
