ADR resolution refers to the process used in an impartial third-party that helps people
in communication and to collaborate and address challenging issues, resolve conflicts, and
make decisions. With the use of ADR it can save money by the reduction of expensive
litigation costs and the promotion of efficient and durable resolution of conflicts. Some ADR
processes must foster a better understanding or information sharing. The ADR process is to
reduce trauma, expense, and stress of divorce of families and their children.
New York is a state that requires the ADR process in all different types of divorce. In
New York, the ADR process involves meditation, facilitation, arbitration, and community
conflict resolution program. Families that are considering divorce needs support to deal with
the process. Families with children need guidance. Couples ask for professional help from
courts, which may help them in reaching an agreement on issues of parenting. The ADR
process can also be instrumental in the dealing of matters involving agriculture and properties
owned by families.
Integrating an ADR process in a civil case flow increases the likelihood of issues in a
legal dispute that will address appropriately and will happen fast or and less cost than a
traditional litigation process. In the early stages ADR movement, the common expectation
regarding the effect of ADR had the courts twofold: Which relieved court congestion and any
delay, it would increase the public satisfaction in the justice system by a diversion of cases
that didn’t require a formal process. The expectations with the use of ADR would lead to
changes in courtroom procedures but would enable courts to conduct any legal courses with
less pressure and congestion.
