According to the facts presented concerning the scenario, Jim Davis had been working in
Freedom University as an office assistant in the Global Studies Department since 2009. Although
he reported to the department's chairperson, he also executed other duties and took orders from
five professors who served in the department. However, he was gay and was in a same-sex
relationship with Andy Miller. At the workplace, the sexual orientation of Jim started
manifesting since he could place a picture of Andy and himself on the desk and his dress code
became provocative because he could wear earrings, tight-fitting pants and shirts, and his jacket
was embroidered with suggestive words such as "gay pride." Due to Jim's change in demeanor
and dress code, the Prof. Becker of the Global Studies Department made harassing and
inappropriate remarks positing that Jim’s appearance was overly feminine. This conduct
provoked him to resign from his job. Following his resignation, Jim filed a lawsuit for sexual
harassment against Prof Becker and Freedom University. Jim claimed that he had been a victim
of a "hostile work environment" and a subject to "quid pro quo" sexual harassment. He claimed
