Throughout most present-day business history, corporations have strived to unlock profit
by equating their frameworks to their approaches. The obtaining and utilizing of contentious
intelligence is becoming increasingly critical in several companies. The shift toward integrating
monetary services intensifies the need for current, concise data (Cavallo et al., 2020). The arrival
of electronic communication such as e-mails, and the web, has significantly transformed business
operations. Since business activities nowadays can be accomplished spontaneously, the demand
for competitive data is at its peak. This paper highlights a few legal and ethical concerns that face
enterprises during the acquisition of competitive intelligence.
Competitive intelligence is regarded as obtaining any data that would aid an enterprise to
have a competitive advantage in the marketplace. This knowledge could include costs, commerce
approaches, delivery schemes, production costs, utilization of information technology and other
analysis resources, and strategic and marketing plans. With the recent progress in information
technology, understanding security issues is essential, privacy issues and the consequential
impacts (Talaoui & Rabetino, 2017). It is essential to recognize the ethical issues to handle these
issues in the IT field.
The legal and ethical issues emanating from the acquisition of competitive data can be
classified into two parts. First, the issues arising from the obtaining of competitive intelligence
by competitors acting cooperatively. These issues can be identified as antitrust or unlawful
competition matters (Talaoui & Rabetino, 2017). Also, some issues transpire when an
organization gathers data from public sources or third parties. These issues include
confidentiality, trade secrets, and civic and criminal infringements of state and federal statutes.
