in all these positions, she purposes to be fair to her workers. Therefore, she wants to know all the
employment law implications that she will be facing will running the business with all these
types of workers.
Discussion
1. Samthann must comply with the wage and hour laws covered by the Fair Labor
Standards Act (FLSA)
FLSA is tailored to protect workers from unfair pay. FLSA covers employers with an annual
gross revenue of $500,000. Given that Samthann will be operating a regional business whose
capital is $1 million, she will probably anticipate such gross revenue. And because she wants her
workers to be fairly paid, her operations must comply with FLSA minimum wages, and overtime
payment requirements outline below;
i. Coverage: First, before applying this law, Samthann must have in mind that it only applies
to employees. The Act does not protect Independent contractors and interns.
ii. Minimum Wages: “If the employee has been paid on the basis of an hourly rate, the rate
paid for each hour must at least equal the amount set by the statue, i.e., $7.25 an hour as of
July 24, 2009, for the majority of workers. 4 Covington, Robert N, and Joseph A.
Seiner, Employment Law in a Nutshell 395. 2017. (West Academic Publishing 2017).
iii. Overtime Payment: Section 7 of FLSA requires that each Non-exempt worker should be
paid a premium for each hour worked for over 40 in a workweek; the required premium is
one half the “regular rate” the worker earns”. 29. U.S.C§207. see also, 4 Covington, Robert
N, and Joseph A. Seiner, Employment Law in a Nutshell 395. 2017. (West Academic
Publishing 2017). However, overtime does not apply on weekend, regular days of rest and
holidays unless it happens that overtime is worked on such days. Besides, the section 7
