The four elements that one must prove in a case of negligence in nursing include the
existence of a duty to the patient which the nurse practitioner must have breached, proof that the
breach of duty was committed, evidence that the patient got injured, and proof that the injury to
the patient was caused directly by the nurse having breached the standard of care (Austin, 2011).
I think that the element that may be harder to prove may be the proof that the breach of duty
occurred by just relying on the documentation. This may be challenging because a nurse may
decide to make the appropriate documentation but fail to show the duty of care effectively in
their actions. It may be challenging to prove that a caregiver acted negligently when there is no
witness or evidence to indicate that he actually acted in breach.
Scenario one of the article talks about the failure of a nurse practitioner to communicate
and monitor the patient while he was in the hospital, contributing to his eventual death.
The lessons that are learned from this include the fact that it is the nurse’s responsibility to
ensure that they follow the standards of care that are recognized in the provision of care. It is also
the duty of the nurse to constantly monitor the patient and ensure that any changes to their
condition are reported to the physician in charge for immediate intervention. In this case, the
nurse was expected to monitor and document any changes to the breathing of the patient and
ensure that the provider for healthcare gets notified immediately (Austin, 2011). The fact that
there was no documentation indicating that the nurse had performed the duties that were
expected of him, and the nurse had no evidence suggesting that she did means that she had acted
in breach of the duty of care.
There are several things that I would have done to avoid the errors that were made by the
nurse who was in charge of taking care of the patient in this scenario. The first thing I would
