(RA 10173)

DEFINITION OF TERMS

Boss One Stop Shop: single common site or location or

single online website or portal for Business Permits and

Licensing System of LGU

Business-related Transactions: set of regulatory

requirements a business entity must comply with to

engage or continue to operate a business

Complex Transactions: applications or requests which

necessitate evaluation in resolution of complicated issues

Fixer: any individual who has access to people working,

whether or not in collusion with them, facilitates speedy

completion of transactions for pecuniary gain or any

advantage/consideration Nonbusiness Transaction: all

other government transactions

Highly technical application: application which requires

use of technical knowledge, specialized skills in

processing or evaluation

Red Tape: any regulation or rule or system that is

ineffective or detrimental in achieving its intended

objectives, and as a result, produces slow, suboptimal and

undesirable social outcome

Simple Transactions: applications or requests which only

require ministerial actions on part of public

officer/employee or which present only inconsequential

issues for resolution

EXPEDITED BUSINESS PERMIT & LICENSES

o Unified Application Form (single application

for business permits and renewals)

o Preliminary Evaluation (all business

applications allow applicants to correct any

deficiencies before submitting actual

application)

o Fewer Transactions (all related

license/clearance/permit/authorization will be

issued concurrently with business permit)

o One-stop shop (all agencies engaged in

starting a business will be housed in one facility

ONLINE REGISTRATION FOR BUSINESSES

o All forms will be moved online, and documents

can be scanned and submitted electronically

o Licenses and permits can be printed from home

or office and shall have same authority as a

hard copy

ACCOUNTABILITY

To ensure compliance, law prescribes administrative and

criminal liability to officials and employees acting

improperly. Violations include:

o Refusal to accept an application

o Imposition of requirements or fees not listed in

Citizen’s Charter

o Missed deadlines

First offense: ADMINISTRATIVE PENALTY

(6-month suspension)

Second offense: CRIMINAL LIABILITY

ANTI-RED TAPE AUTHORITY (ARTA)

- Responsible for enforcing Ease of Doing

Business Law in the Philippines

ELECTRONIC COMMERCE ACT OF 2000 (RA 8792)

OBJECTIVE

- To facilitate domestic, int’l dealings to recognize

authenticity & reliability of electronic documents

COVERAGE

- Any data message and electronic documents

used in commercial and non-commercial

activities to include domestic and int’l dealings

DEFINITION OF TERMS

Electronic Key: secret code which secures and defends

sensitive information that cross over public channels into a

decipherable form

Intermediary: any person sends, receives and/or stores

of electronic data message

LEGAL RECOGNITION

1) of Electronic Data Messages

- Info shall not be denied legal effect or validity

2) of Electronic Documents

- Legal effect or validity as any other document

OTHER NOTES

- The place which has closest relationship to

underlying transaction is the place of dispatch if

originator has more than one place of business

- The Department of Trade and Industry is

empowered to promulgate rules and regulation

for implementation of this Act
