The numerous road accidents that usually occur all over the world on a daily basis can be
attributed to a number of causes. Some of these causes include careless pedestrians, careless
drivers and bad roads. A large number or portion of these causes are as a result of the
carelessness of the drivers and their ignorance of the road signs or the ignorance that there are
other road users apart from them. Drunk driving is the major cause for alarm. A drunk driver
is a danger to himself and to the other road users. Drunk driving is a major cause for accidents
since the driver has no knowledge of what he is doing and/or throws the caution to the wind.
To curb this, the police officers usually look for the drivers who are drunk during the evening
hours. This is because this is the time that most of these drivers are coming out of their
drinking joints heading home and most of the reported drunk driving accidents occur in the
evening hours. The police have got to up their game and try and curb this menace which
threatens the lives of many people.
Let’s take the following example of a DUI case where there was a driver who was
pulled over and forced to conduct a DUI test so as to ascertain that he had no alcohol. The
breath and urine tests then revealed that he had no alcohol in his system. The culprit, Ronald
G. Ayers, then sued the police for wrongful arrest and negligence (Marrero). In another case,
there was a drunk woman who was driving while drunk and was involved in a fatal road
accident that claimed the legs of a high school principal. The culprit, Marilyn Aguilera, was
found to be well above the acceptable alcohol limit and her SUV crashed into a baseball field

where the principal was training his students and crahsed him (Driver arrested, faces DUI
charge in crash that maimed South Dade principal).
In both of the cases above, the police usually find themselves at crossroads. They
usually pull someone over for any minor traffic offense and then visualize the driver’s state
before asking the driver to take an alcohol test. The results of this can be tragic and sometimes
even offend the driver. The Fourth Ammendment has had its own share of intepretations.
Considering that the Fourth Ammendment basically talks about the search and seizure. There
are many annotations pertaining to this particular ammendment.
The Fourth Ammendment protects the American citizens from unnecessary searches
and seizures. This basically means that majority of the time, the police are not required to
simply pull the drivers over and inspect them whether they have a high or low alcohol intake.
This may seem to be a violation of their rights and where it matters much. The drivers should
not be forced to take an alcohol test without reasonable cause. These reasonable cases include
reckless driving, slurry speech by the driver and any other alcoholic tendencies that are
exhibited by the driver.
The Ammendment then goes on further and state that the searches and seizures are not
completely prohibited. However, if there is reasonable cause, the search may then be
conducted. In the case of Ronald G. Ayers, the police were right to conduct the alcoholic test.
They were in no way violating the Fourth Ammendment, rather, they were acting according to
the ammendment’s rules.
