Which constitutional amendment do you consider most important to policing?
The fourth amendment, which states that the police cannot search a house, a person, and their
things without probable cause; also cannot take anything from a person without reason.
Why do you think it is the most important?
Because without probable cause the evidence found that could be used against someone could be
inadmissible in a court of law without proper procedure.
Which amendment do you think has been most broadly interpreted?
The fourth amendment.
Why do you think this amendment has been the most broadly interpreted?
Because the amendment could be the difference between a decision of guilty and not guilty. The
most incriminating aspect of any case is the evidence, which in many cases is found on or in the
residence of the individual. If proper procedure is not followed to collect the evidence it could be
found to be inadmissible in a court of law.
What has happened in society to influence this interpretation?
Science can take the smallest trace of something and make a connection from the offender to the
victim. Forensic science is the most damming evidence to use in a case in my opinion and the
one fought the hardest by the offenders attorney. It’s easier to try and prove a violation of the
accused rights rather than the forensic evidence.
