INDIGENT PERSONS 2
The services required for indigent persons being processed by the court system include
being accorded the opportunity of choosing their lawyers and scrutinizing jury statements,
especially those that are racially discriminatory. The two identified services are provided to
indigent persons to achieve one key objective: to ensure that there is fairness in expediting
justice. For example, the service of indigent persons choosing their own court-appointed
attorneys will ensure that defendants who cannot afford legal counsel on their own are
represented hence also operationalizing the right to an attorney. Through this legal
representation, attorneys can act on behalf of indigent persons and even give them the requisite
legal counsel, which is a necessary feature for a fair trial. Initially, United States did not have this
service since the supreme court had ruled that defendants should not have the choice in the
Morris v Slappy case, but this has since changed in some states such as Texas, especially with
backing from various scholar in the United States (Laird, 2018). Again, the service of
scrutinizing jury statements, especially those that are racially discriminatory, ensures that
discrimination is not allowed in courts as it would hamper the jury's dispensation of fair justice.
Offering the above-discussed services is an appropriate expenditure of community
resources to assist the indigent. This is since even these indigent individuals have various rights
that can be hampered if they are not allowed to choose their attorneys. Such rights include the
right to a fair trial and the right to an attorney, and therefore it is worth using community
resources to ensure that everyone is accorded equal protection of their rights, including the
indigent. Again, it is worth noting that indigent individuals have not yet been proved guilty
hence innocence presumption applies, and this shows the appropriateness of using community
resources to protect indigent persons.
