It is beyond any doubt that The Upside Down infringed on Netflix copyright by using
familiar scenes from Netflix show (Selvam). In my case, I would treat this instance as a criminal
act and sue the bar. This is because; it was directly benefiting from Netflix and accumulated
profit on its intellectual property. I would seek for damages arising from their action that I would
treat as being ignorant of copyright laws.
By using the name Roubaix, Specialized can claim an infringement on their trademark.
However, the source of this name is unclear, as Richter claims to name his business from Paris-
Roubaix, while Specialized may have been the first one to use this name from the same source in
the industry. Therefore, if I were Specialized, I would use this as an opportunity to introduce
Roubaix bikes in U.S market. It would be a great channel for expanding internationally as the
Americans would not have a problem in accepting the bikes as substitutes to Richter’s bikes. I
would try to avoid conflict when am introducing this product in a market that has already
accepted it.

I agree with Netflix decision, to demand that the bar seeks permission from Netflix, and
should shut down after September (Gould-Bourn). This is because, by doing so, Netflix invites
The Upside Down to agree on how to pay for the use of their trademark. Picking up a fight with
a small bar would otherwise paint a bad picture for Netflix, which need to retain their customers.
I disagree with Specialized Company response to engage Café Roubaix in a David and
Goliath clash (Gulley). This is because I see this as an open door for Specialized to begin
expanding business in U.S market because the name is already established.
