Legal issues
The Equal Employment Opportunity Commission is responsible for making that there is
zero discrimination in all the organization. Hence files disputes in the court arms on behalf of the
employees. The first legal issue is whether the allegations that Gutierrez has been sexually
harassing two servers that is Michelle Powell and Katrina Shisler. According to title VII of the
Civil Rights Act, an employee should not be discriminated against by gender, race or the national
origin. Hence the question is whether the allegations were true that they have been sexually
harassed while working at the Racine IHOP. The courts found that the accused whom was the
assistant manager has been touching the server’s body parts and using abusive language which is
meant to harass them. Gutierrez has spanked both Katrina and Powell. This shows that the server
were sexually harassed.
The second legal issues are whether the management responded to the complaints by the
employee. According to the servers that is Powell and Katrina, they both reported to the Del Rio
and Dahl who took no actions to stop the habit like a warning of terminating the contract of
Gutierrez. On the other hand, Katrina in the previous year, she has reported sexual assault by her
former manager who was called Hecker. (Hyman, 2012)This resulted in her being treated fair by
the manager. This means that the managerial had failed in responding to the sexual assault until
when it was reported of a private instigator in the organization is when Smith took statements.
Lastly, another legal issue that was in question is whether the organization had put
enough policies and procedure which will enhance of the title VII of the Civil Rights Act. Dahl
admits despite being the assistant manager at the Racine IHOP; she has the role of ushering new
employee. But she has never trained them of any discrimination practices. The organization has
