Introduction
The United States Equal Employment Opportunity Commission (EEOC) reports that the
country’s largest source of employees reporting sexual harassment result from the restaurant
industry (Forman, 2013, para. 1). This includes harassment in the form of physical behavior that
is sexual in nature, unwelcomed sexual advances, comments about an individual’s gender,
requests for sexual favors, and verbal sexual harassment towards an employee. While sexual
harassment has been an issue in the workplace for many years, it has been spoken about and
reported more often today than in the past. Restaurants are being sued more often as a result of
employees coming forward regarding this unlawful act. Restaurant profits are disappearing into
legal fees and settlements. Not only are these type lawsuits costly, they can harm a business’
reputation, employee morale, and it takes time and energy defending themselves (Forman, 2013,
para. 2). It is important for restaurants to take harassment complaints seriously and to recognize
sexual harassment, investigate it, and be responsive to the act once it occurs. Recognizing such
things as jokes, emails, texts, comments of sexual nature, or inappropriate touching is extremely
important. Taking prompt action will keep the harassment from recurring. There are policies,
procedures, and employee training that can be put in place to protect a restaurant from these
types of legal ramifications. Title VII of the Civil Rights Act is a federal law that forbids illegal
gender discrimination in the workplace and sexual harassment is an unlawful form of this federal
law.

Recently, The International House of Pancakes (IHOP) is one of those restaurant chains that
has been found guilty by the EEOC for the unlawful act of Sexual Harassment of their
