Many states have legalized the use of marijuana and the State of Florida, where I reside, is
one of those states. On November 8, 2016, Florida became one of the 28 states that made
marijuana use legal (Florida Marijuana, 2016, para. 1). Medicinal marijuana use is what was
legalized and people who suffer from conditions that can be improved or alleviated through the
use of prescribed forms of the drug is permitted by law to use it. One of the issues at hand are
whether or not employers are prohibited from punishing or firing employees who use medical
marijuana. Amendment 2 protects people from being criminally charged if they have a
prescription from a licensed physician. However, Amendment 2 does not provide a great deal of
information directing employers on how they are to handle the use of medical marijuana by their
employees. The amendment does state that it is not necessary for employers to accommodate the
use of medical marijuana at the workplace. If part of an employees job includes operating
motor vehicles, then it is possible, under Amendment 2 for the employer to prohibit an employee
from using marijuana because this amendment prohibits driving under the influence of marijuana
when the person is using the drug prescribed by a physician (Florida Marijuana, 2016, para. 3).
While Amendment 2 does not say whether or not employers are permitted to enforce drug
testing policies against medical marijuana users, other states where this question has been raised
have found that employees are not protected from drug testing policies, or even from being fired
or disciplined on the basis of these drug tests. There are states that do protect employees from
these type actions, Florida’s amendment does not create such a protection (Florida Marijuana,
