Introduction
The Equal Employment Opportunity Commission (EEOC) has brought a sexual harassment
lawsuit against Management Hospitality of Racine (MHR) on behalf of two teenage-female
employees, Katrina Shisler and Michelle Powell, who worked as servers for a restaurant
franchise that MHR owns called International House of Pancakes (IHOP), located in Racine,
Wisconsin. After many complaints from Shisler regarding sexual harassment from a manager,
management ignored the complaints and fired the teenager (Dresang, 2006, para. 1). MHR is
owned and operated by Salauddin Janmohammed, who also owns twenty-one IHOP franchises.
His wife, Victoria Janmohammed solely owns Flipmeastack, a company that provided
management consulting services for the twenty-one IHOP franchises her husband owns (Federal
Jury, 2009, para. 3). Some of Flipmeastack’s management consulting services consisted of;
corporate IHOP franchise reporting and compliance and human resources assistance (Walsh,
2016, p. 314). Victoria Janmohammed claimed a zero-tolerance sexual harassment and
discrimination policy was in place for each of the twenty-one IHOP’s and required managers to
show all employees of the restaurants a sexual harassment and discrimination educational video,
as well as, sign a document stating the employee read the policy. There was also a Crisis
Management Guidelines poster that was placed or located on a “busy” bulletin board in the
employee breakroom of the Racine IHOP restaurant. The sexual harassment policy did not have
nor did the Crisis Management Guidelines poster have a point person listed for employees to
contact in case they needed to report inappropriate conduct or file grievances. The Flipmeastack
Company was responsible for hiring IHOP’s district managers and the district managers were in
charge of hiring the general managers for each IHOP franchise owned by Janmohammed.
