Alternative Dispute Resolution
There are several types of alternative dispute resolutions for cases that include arbitration,
mediation, neutral evaluation, and settlement conferences ("ADR Types & Benefits", 2019).
Arbitration
Arbitration is where you have a neutral individual who is called an arbitrator who acts
like a judge makes a decision from what they hear from each side. Arbitration can be binding or
nonbinding ("ADR Types & Benefits", 2019). Waving their rights to a trial and accepting the
decision of an arbitrator is an example of binding. When the parties do not accept the decision of
the arbitrator they can request a trial is an example of nonbinding ("ADR Types &
Benefits", 2019). If I was a general manager of a baseball team and if there was a contract
dispute on how much a player wants I would use arbitration to try and come to an agreement.
Mediation
Mediation is where you have parties trying to settle a dispute and they have a mediator
come in. The mediator does not make a final decision they help them communicate and they
leave it up to the parties to decide ("ADR Types & Benefits", 2019). A time to use a mediator is
when you want to still have a relationship, could be a family member or a close personal friend.
Conclusion
In conclusion, alternative dispute resolutions are usually cheaper and less formal ("ADR
Types & Benefits", 2019). These ways relationships can still be maintained and everyone can
move on without going through the court system.
