The alternative dispute resolution (ADR) should be used by Solar and XYZ Media’s
CEO. The best method to resolve this issue is to use the (ADR) with arbitration or negotiation.
The contract is six months long, and Solar Company is tarnished and is at risk of losing a

Considering using the nine factors, included would be; losing and winning odds, awarded
or ordered of money, fees for lawyers and litigation, managers and personnel loss of time, parties
relationship and reputation, legal system unpredictability and possible error, and aggravation and
psychological costs from a lawsuit (Cheeseman, 2016). The situation with Solar Company and
XYZ Media’s these nine factors apply; 1. Between the two companies, the contract depends on if
Solar has a strong case in winning. 2. Solar paid $200,000 to XZY Media and is looking to
receive it back for the first two months of the six-month contract of $600,000. 3. There are no
layer fees specified, depending on how long the case goes it may vary. 4. Managers and
personnel time loss. 5. The black eye and tarnished image of Solar Company and their additional
lawsuit despite who fault it is. 6. By law Solar Company and XYZ Media have prejudgment. 7.
The lawsuit aggravation and psychological variant. 8. Legal system unpredictability and possible
errors in the judgment. 9. The reputation of the companies (Cheeseman, 2016).
Settlement
Considering these nine factors Solar Company CEO should reach out to XYZ CEO and
try to negotiate. This part of the (ADR) may be quicker for a favorable outcome and both parties
can move forward. In the long run, decisions being based on irrational feelings may be damaging
in the future. Something that could happen is that Solar Company for the last two months
