From the fact of the case, Jane is a victim of non-consensual image postings while Joe is
a citizen who believes in the First amendment whereby the constitution grants its citizens the
freedom of speech. In this study we will examine the delicate balance that exists between the
right to privacy harbored by Jane and Joe’s right of expression. In other words, it will analyze the
underlying liabilities of their actions with the outstanding responsibilities of both parties.
In the case of Jane, her intimate pictures have been posted in a nonprofit website without
her consent. In such contexts, she has lost control over the distribution of intimate images of her
upper torso taken while at a campus party. Victims of such nonconsensual postings that involve
the distribution of imagery of obscenity subject the victim to abuse, harassment, and
embarrassment. As the image’s distribution takes root it goes past invasion of privacy and goes
further to shame the body of women as it spreads throughout the network. Serious harm is
occasioned that ranges from slurs from the public to a feeling of helplessness since the victim has
no control over its distribution. Such posting also bring about serious abuse especially for easily
identifiable victims in relation to opportunities of employment and education. In some instances
there is occasioned a threat of bodily harm or a loss of employment. The victim also suffer from
a identity crisis issues since they lack the ability to control how they are to be portrayed to the
world. Jane is under threat of such circumstances. However, despite the threat of serious harm on
Jane’s request to Joe to take the content down may not be viable in a legal perspective. The legal
immunities forwarded by the right of privacy may not be enough by themselves to compel the
removal of the images. Such factors under consideration include the age of the victim and the
intent of posting the images. Since Jane may be considered as an adult of 18 years, the posting of
the image may not be considered as a child pornography siting. On the other hand, the action of
