The Malson & Sons Company had submitted a bid to supply construction materials to the
upcoming construction of a referral government hospital. The regulations laid down by the open
tender said that the tender was only open to small businesses that had their roots in the California
state where the construction would be taking place among other qualifications which the Malson
& Sons had complied with to their satisfaction before submitting their bid. It however came to a
shock to us when we found out that our bid had been labeled as unsuccessful and we therefore
decided to protest this. This is how we shall approach this issue.
The company should first decide on one or two methods of lodging the protest. This could be
through telephone, written form, orally among other acceptable forms of lodging a protest. Once
this has been decided, the company should make sure that the protest is lodged within the
required legal time frame; usually ten days for it to be considered as legitimate (Jones, 2010).
The protest should be lodged to the contract officer who was in charge of the procurement who is
then expected to forward the protest to the US Small Business Administration for hearing and
determination. The company has fulfilled this and has written concrete reasons on why it thinks
it was unfairly discriminated. First, the awarded company has a long standing partnership with
TATA, an international company with roots in Japan. This is proved by the attached statements
that show the company having earned revenue from the parent company for the last three years.
We therefore feel that it is automatically disqualified based on technicalities and the Malson &
Sons Company should be awarded this contract.
