The exclusionary rule does strain the criminal justice system in that requiring the proper handling of
evidence as well as documentation such as the chain of custody, while a good thing, also can result in
having a negative effect as any part of improper handling and/or unkept documentation can result in a
defendant getting off on a technicality. According to Gaille (9 Exclusionary Rule Pros and Cons, 2017),
because of such scrutiny given to law enforcement, it is their conduct, rather than the crime that was
committed and the harm that may be experienced by victims, that is more closely focused on.
In its fairness, the exclusionary rule helps in avoiding prosecuting people who may be innocent in the
requirement of the exclusionary rule in there being evidence of wrongdoing and having probable cause
with the assumption a person is innocent until proven guilty by a jury of their peers (9 Exclusionary Rule
Pros and Cons, 2017). If there was no existence of the exclusionary rule, law enforcement would be able
to conduct searches at which will potentially result in the planting of evidence as well as evidence being
handled improperly.
