. Victim’s right movement
Victimization refers to the process where one is victimized or is made to become a
victim in a certain scenario. The movement was started to ensure that victims who are
accused of a crime are entitled to rights. The rights include the right to participate in the
proceedings, the right to speak at the proceedings and the right to a fair trial. The movement
was started after there was a total spraying off of the justice system in America and that was
not a fair practice for the people involved. It was started almost 30 years ago and it has
become very successful with time (Elias, 1993).
The movement has had a very drastic impact on the criminal justice. The law has undergone a
number of changes in order to accommodate the movement. In the system, it is stated that
rights that the constitution guarantees are stronger than the rights that may be set on statutes
only. According to the law, there is no law of any state that is valid if at all it violates the
constitution of the state. The rights of victims were included in the constitution and that gave
them some level of permanency. This is because a statute which is ordinary can be changed
by the legislature any time and very difficult to change the constitution (Englebrecht, 2011).
The rights have also ensured that the rights are enforceable because they are stated in
the constitution. In any instance that an agency of the state violates the rights, the court has
the authority to order the agency to comply. The movement has ensured that most states have
amended he rights and that all victims are treated fairly (Elias, 1993).
The movement ensured that the rights of victims are included in the constitution. A
victim now has rights that are protected by the law. The first right is that of attendance. The
movement ensured that all victims are accorded the right to attend their proceedings. That
helps the victims to be aware of the progress of the case that they are involved in. the
