Director, Missouri Department of Health, 497 U.S. 261 (1990) was the first case in a U.S. court that involved the “right to die.” The case was an appeal made by the state of Missouri after a 1988 ruling made by a Missouri court that permitted the removal of the feeding tubes and life support from the patient to let her die. However, the state appealed in the United States Supreme Court, and the court overturned the decision of the lower court. In the Supreme Court ruling, the State of Missouri won the case in an ultimate numerical vote of 4-3. The case was a landmark case that made the rules that should be followed in “right to die cases.” According to the court, there should either be a living will or strong evidence of the wishes of the patent before terminating their treatment (Cornell University Law School). According to the decision by the court, it is important to consider the desires of the patient rather than just their proxies before removing a person from life support.
