Vassilkovska was the first to file a complaint against Woodfield over their arbitration agreement and sales contract. Woodfield then followed suit to dismiss and compel the arbitration, which the court denied after hearing the supporting arguments. Woodfield still sought reversal of the court ruling that denied his motion to compel arbitration. All these court trips originated from a contract that showed a certain amount of unpaid balance for Vassilkovska. Both parties signed an arbitration agreement that waived rights to pursue legal action in a court. The arbitration agreement, however, had certain exceptions related to failure to the agreed down payment, failure to provide proper title to trade-in vehicle, issuance of a check not honored by the bank, the buyer’s misrepresentation of the balance among others. The discrepancy in the amount was between the financing agreement that Vassilkovska received later, and the purchase contract resulted in a complaint against Woodfield. The plaintiff alleged fraud from Woodfield’s misrepresentation of the price. Woodfield then made efforts to dismiss the motion with a defense that it was an improper venue regarding their arbitration agreement.
