The Billings v. Town of Grafton Court Case
Facts of the Case
The case brief above involves a civil action that rises out of the alleged sexual harassment
of an employee of the Town of Grafton. Nancy Billings, a secretary to Town Administrator
supervisor Russell J. Connor, filed a case against his superior for injuries arising out of alleged
sexual harassment for approximately three years. Initially, the complaint stated claims of sexual
harassment and discrimination, retaliation, and intentional infliction of emotional distress
against both the Town of Grafton and Connor. However, the defendants (Connor and the
Town) filed a motion for summary judgment to all counts on. Billings returned to court to
make an additional allegation of retaliation by the Town and Connor based on the events that
happened after filing the lawsuit while at the same time moving for an extension of time so
she can complete her discovery.
Procedural History
Despite all these efforts, the court issued a memorandum and ordered the defendants
to be granted summary judgment for claims of sexual harassment, discrimination, and
intentional infliction of emotional distress. More so, the district court ruled out that Billings
had no enough evidence against retaliation claim. The circuit court ruled out on the following
as a matter of law; first, the court held that the Town Administrator alleged staring at Billing's
breast did not create a hostile working environment for her. In the second holding, the court
asserted that the transfer of Billings to another secretarial position in the Recreational
department, among other things after she complained of Connor's behaviors, did not amount
