Application of Tort Law in Health Care Project Management Protocols
A tort refers to an action that harms the recipient regardless of the knowledge
of the actor. It entails the violation of other people’s rights. In the medical profession,
tort laws are instituted to enhance the security and the welfare of the patients and
other practitioners within the field. Various malpractices constitute the major torts in
this industry. They can result from either negligence on the part of the professionals
or intentional motive to harm the patients. Once the torts occur, the harmed parties
seek defense from the court where they sue the defendant who may be an officer in
the medical field for any injury caused by the patients or the other third parties. The
ultimate goal for suing is to get the necessary compensation (Cornford, 2016).
Although the introduction of the tort law is not the ultimate reducer of the high
costs that the patients incur, it enhances the safety of the patients and the focus of
medical experts in the performance of their medical roles. For instance, in the tort of
product liability, the companies are required to carefully design their products to be of
help and not to harm the patient. In case a drug from a given company is prescribed to
a patient in the right manner, and it ends up affecting the patients negatively, the
contents of the drug are counterchecked by the relevant authorities. If the drug does
not conform to the expected standards, then the medical company is held responsible
for the harm caused in such a patient. Therefore, this protection code ensures that the
patients are protected from the unscrupulous companies whose interests are directed
towards monetary gains and not the patients' welfare (Cornford, 2016).
The major goals of the laws are to ensure professionalism in the medical field.
They act as guidelines for the compensation of the injured patients. They enhance
responsibility and accountability for one's actions as the practitioners responsible for
