In summary, within the aforementioned case the petitioner (Entergy) had filed a suit challenging Court of Appeals judgment in Riverkeeper v EPA 2007, which held that CBA (Cost-Benefit Analysis) should not be utilized in interpretation of the statute of the Clean Water Act to establish NPS and BAT for the existing power plant.
