Abstract
Throughout history, individuals have formulated ways to assert their rights and seek
redress. The development and application of law has changed in response to society’s dynamic
needs while its survival is based on customary usage. In some instances, laws may be regarded as
immutable and function as frameworks for other laws within the system to follow while others
are dependent on a parent law and are reviewable as time moves on. The promulgation of most
laws is by a democratically elected government, while nevertheless, they may be imposed by a
superior order. Law is invoked to define rights, create obligations and provide sanctions against
non-compliance with its dictates, establishing the link between morality and law. The application
of Mexican legal system is founded on old conception and the modern state, organized under the
rule of law, culminating into the trilogy and conjugated connected individual, family, state. Law
posits that what affects the individual affects the family and consequently, state and society, its
disintegration or violation undermines the ties underpinning human society and the state is
weakened. The traditional theory maintains that subject of law is an object of a subjective right
or legal obligation. Subject of law is capable of holding powers and duties, which from a moral
perspective, is endowed with free will and reason and the capacity to establish purposes freely.
