How the justice system fails people with disability and how to fix it
In Australia, there are people that suffer intellectual disability. At times this person gets
involved in the system of criminal justice. This group is usually defenseless and disadvantaged
group in the region. According to research the group of people that suffer from intellectual
disability usually are uneducated and they experience problems like unemployment, poverty and
also are usually from the indigenous minority group. Right from birth, they experience abuse and
rejection in the community. They also have poor communication skills making it hard for them
to express themselves. Those who belong to this group are poorly represented and sometimes
their justice is undermined. The offenders with intellectual disability experiences both
physiological and social challenges. There has been a lot of injustices for the disabled where they
have been imprisoned and others have experienced institutionalization. People with intellectual
disabilities may find themselves in the criminal justice system on the different basis like as an
offender a witness or a victim. If he appears as an offender their treatment by the system is
usually common. They always face institutionalization. This person should be treated fairly and
they should be treated with care on the judicial system. Their lawyers should be in a position to
understand their special needs for them to be assisted giving instructions and understanding the
judicial system.
