2. Discuss the debate over same-sex marriage in this country. The US Supreme Court
recently ruled that same sex marriages must be allowed in all of the 50 states. Consider the
ethical and constitutional arguments on both sides. On the basis of that discussion, which
side do you believe should have ultimately prevailed? Why? In answering this question be
sure to think about the Constitution carefully. Is this an example of federal overreach, in
your opinion? Explain.
The debate on same-sex marriage has been very persistent over the years. This was until
the US Supreme Court came to a conclusive decision that same-sex marriages should actually be
allowed. The debate has however come to an end given that this decision has several legal,
social, cultural and religious implications. Some of the ethical arguments on the same-sex
marriages include the fact that same-sex marriage is considered unethical and immoral. This can
be traced from the beginning of time where intimate relationships between people of the same
sex were considered immoral (Hertz & Doskow, 2016). Another argument against same-sex
marriages is that they are contradictory to spiritual teachings and beliefs. Moralists are therefore
very vocal against same-sex marriages.
On the other hand, the constitution advocates for equality and condemns discrimination
of any kind based on sex, age, race or even sexual orientation. This could have been the very
reason why the Supreme Court upheld this decision. The courts are the custodians of the
constitution and they are therefore supposed to work in fidelity to the constitution (In
Mukhopadhyay & In Harding, 2017). In my opinion, upholding the constitution is very
important given that it is the law that governs every citizen. Contravening the constitution would
bring about several legal questions in this issue. At the same time, having a contradictory
judgment would have enhanced discrimination on the basis of sexual orientation. I however
