Introduction
The human resource element is the most useful part of an organization because for a
business to accrue benefits from its activities, people must be brought in to control all other
factors of production. Staffing is regarded as one of the primary functions of management and
refers to the process by which the right personnel is selected to fill the vacant positions in an
organization. The administration must ensure that the appointed people are the correct number
and also possess the proper qualifications (Phillips et al 2015). To protect the rights of workers at
the job place, various laws, as well as government, initiated activities have been put in place to
ensure that the employers do not exploit employees at the expense of their benefits.
The Fair Labor Standards Act
These laws together with government activities have had an impact on how organizations
conduct the staffing process. The Fair Labor Standards Act is among the rules that have been put
in place. The act was enacted in the year 1938 due to increased rates of depression. FLSA
dictates the minimum wage that employees should be given, sets qualifications for overtime
eligibility and the child labor standards. With this law, the salary pay that employees acquire for
example increased from 455 dollars to 970 dollars per week and also divided employees by
exempt or non-exempt employees to define who is eligible for overtime pay.
With these changes, organizations have been forced to change their staffing process to fit
in the FLSA and avoid incurring too much cost on staffing (Fine, 2017). Some of the changes
include the review of job descriptions to make them more realistic in stating the duties under a
particular position and also updating them often to ensure employees are well classified. To
reduce cost also, most organizations have changed their job description to include a broad scope
