Prior to 1960s, every prisoner had a consequence of his crime and at that time, he was the
slave of the state. However, from 1960 and early 1970, it turned to be the turning point for the
rights of the prisoners (Bright, 2015). The Supreme Court began expanding the constitutional
rights given to prisoners which some include the right of the prisoner to access the court,
minimal protections of the first amendment, freedom of cruel and unusual punishment and many
others. The paper, therefore, explores the correlation between the case decision that addresses the
rights of prisoners and the issues addressed in the Supreme Court case decisions.
There is a correlation in a case dealing with the First Amendment protections of inmates
in communicating with one another and in marrying. Often, the rights of First Amendment are
given the priority from infringement and can't be abbreviated less the government has a
compelling concern in the restriction. The Supreme Court held that it is valid for the prison rule
which limits the rights of the First Amendment of inmates in communicating with each other if it
is logically connected to the justifiable penological interest (Thaman, 2011). However, in doing
so, the court considers factors that there is a coherent link between the constraint at matter and
the legislative interests in justifying it and also the factor that there is the accessibility of
unconventional means in exercising the restricted right.
A clearer correlation is found in the treatment of cases in the Court where prisoners assert
that the situations of imprisonment infringe the prohibition of the Eighth Amendment on ‘cruel
and unusual punishment.' Earlier, the Supreme Court intimidated that "the Eighth Amendment is
violated whenever the conditions of confinement fall below the minimal civilized measure of
life's necessities" (Bright, 2015). However, this drastically changed and it became that the
situations that are independently uncivilized are to be held constitutional if not there is a verdict
