Scenario 1: Detailing how Tasha was not in a Contractual Relationship
The analysis here encompasses a principle in common law that says that promises
between people who have close relations through consanguinity are not enforceable in court. The
rationale for this is that the familial relationship is prone to very many disagreements which are
rarely fatal to the relationship. However, courts enforce obligations; there is a real chance that a
decision on the matter can damage the relationship permanently. A classic case to illustrate the
point is Balfour v Balfour. IN addition to the court refusing to determine the existence of an
actionable promise, it went on to hold that family members can’t take each other to court over
obligations. Thus, Tasha cannot claim a right in personam against her aunt. Similarly, Tasha
cannot request consideration because there was never an offer to her in an actionable way.
Scenario 2: Illustrating How Officer Friendly Does Not Deserve the Award
A contract is formed through very many avenues. However, there is an irreducible set of
qualifications that every contract must adhere to be valid. The contract that is spoken of in this
scenario is an open contract. That is, the offeror is known while any member of the public can be
the offeree (Fuller & Eisenberg, 2006). In this case, the question that will be determined is
whether the public encompasses a police officer. Friendly did not get information about the
capture of Doesnogood as a private citizen. Therefore, he was discharging his duties as is
stipulated in the contract of service that keeps him in employment. It is from there that Officer
Friendly gets the consideration for acts. In other words, he is not a member of the public when he
is discharging his official duties.
