This is a complaint for misrepresentation and non-payment of bar membership dues filed against respondent Atty. Francisco R. Llamas. In a letter-complaint to this Court dated February 8, 1997, complainant Soliman M. Santos, Jr., himself a member of the bar, alleged that Atty. Llamas, who for a number of years now, has not indicated the proper PTR and IBP OR Nos. and data in his pleadings. If at all, he only indicated IBP Rizal 259060 but he has been using this for at least 3 years already. On the other hand, respondent, who is now of age, averred that he is only engaged in a limited practice of law and under RA 7432, as a senior citizen, he is exempted from payment of income taxes and included in this exemption, is the payment of membership dues.

LABOR LAWS AND SOCIAL LEGISLATION; CONDITIONS OF EMPLOYMENT; CAPTAIN OF VESSEL A CONFIDENTIAL AND MANAGERIAL EMPLOYEE. — It is well settled in this jurisdiction that confidential and managerial employees cannot be arbitrarily dismissed at any time, and without cause as reasonably established in an appropriate investigation. Such employees, too, are entitled to security of tenure, fair standards of employment and the protection of labor laws. The captain of a vessel is a confidential and managerial employee within the meaning of the above doctrine.

Under Art. 55 of the Family Code of the Philippines, a petition for legal separation may be filed when there is repeated physical violence or grossly abusive conduct directed against the petitioner, a common child, or a child of the petitioner. Note that repeated physical violence is required. I’m wondering what the interval between the violent episodes should be for there to be repeated physical violence. Like, if a husband hits his wife once a year or once every five years, is there repeated physical violence?
