A case brief is the presentation of an opinion made by the courts or simply an analysis. The
function of a case brief is to create understanding of the case and helps one gain skills in legal
reasoning. They also act as a reference of the case and are used for study in schools and different
institutions. There are several steps involved in the briefing of a case.
The first step is always getting to know the whole story and this will require that you read
through the whole case and the ruling made so that you can all the facts of the case. You will
then write down the basic details of the case like who the participants are, the judge, the court
that handled the case, the ruling that was made, the date it was made among other things.
Statement of facts
Here you will identify the parties and the relationship between them. You will then state the
issue that brought them to the court. Analyzing the issue you will identify all the legal aspects
and facts that will prove or disprove the case in the court and the course of action.
History
This is all the information on the case from when it entered the legal system up to the position it
currently is in. all the decisions made in all the stages, if there was an appeal, if any damages
were awarded etc.
