Application of International Law
International law refers mainly to a body of stipulated rules and regulations that are
established by a treaty or custom and which are accepted by nations as legally binding in their
affairs with one another. International law therefore consists of a set of rules, which are
regarded generally and are accepted as having a bond in the relations between nations and
between states. International law mainly serves as a structure of organized and stable
international relations. It is paramount to note that majority of international law is usually
consent-based governance while only a few of them are not consent-based. International law
has three fundamental legal disciplines that include supranational law, conflict of laws or
private international law, and public international law (Wallace & Martin-Ortega, 2009).
On the other hand, arbitration refers to a cost-effective and time-tested alternative to
litigation. The noble concept of arbitration is popularly known as a dispute submission, which
consists of various impartial persons in pursuit of a binding and final decision, which is
referred to as an award. These awards are normally made in writing in order to prove as
evidence and they are mainly binding and final between the parties concerned in the case.
The American international arbitration law is of paramount importance has hugely grown
greatly in accordance to a recent research that was conducted by authoritative scholars. The
major reason for this concept has been the humongous move by majority of the American
companies to expand into foreign markets and they require to safeguard their business
interests at the United States. It is paramount to note that arbitration has been widely utilized
as a method of resolving many transnational disputes that involve American parties. The U. S
is mostly chosen as a suitable place for various international arbitration proceedings (Evans,
2010).
The noble Federal Arbitration Act was enacted in 1925 and it provides provisions for
judicial facilitation to private disputes resolutions through arbitration. The Federal
