David Dees V Saban Entertainment
The contract is a contract is a contact means that a legal contract is enforceable regardless of any
mitigating or intervening circumstances. This is usually applied in instances where the contract
does not specify the extenuating circumstances that may make it impossible to fulfill a contract.
In this context, Saban Entertainment could claim that just because David Dees had signed the
independent contractor agreement without taking advice from counsel through which he gave
away his claims to copyright, the contract did not become void just because the company had
become incredibly successful using the logo he had designed. Saban Entertainment, in this case,
claimed that David Dee had been hired to do a job and he was paid for his services as an
independent contractor. According to Saban Entertainment, therefore, David Dees was not owed
anything despite his logo been used to build a multi-million empire.
The doctrine of equity is based on the concepts of fairness and morality; it is, therefore,
more of an ethical jurisdiction. Therefore, in this case, the laws of equity can come to the defense
of David Dees since they were meant to ensure that the law would have sufficient flexibility with
the intention of preventing injustice. Furthermore, copyright law is often very dependent on the
doctrine of equity because law and statutes that govern this area are often outdated and reforms
that have been carried have done very little to address the inadequacy that exists in protecting the
copyrights of creatives and innovators. In a lot of cases, it has become essential for the courts to
step in and protect the integrity of the copyright system from malicious corporations which have
found loopholes to circumvent through. There has been a lot of copyright jurisprudence in an
attempt to ensure that traditional values of equitable decision making are maintained in the
justice system. The doctrine of equity exists to ensure that the gap between formal law and
justice is closed (Balganesh & Parchomovsky, 2014). In this case, I believe David Dees was
