The increase of public sector unions, whose main mandate is to bargain for their
members’ interests has led to a number of problems for governments. In the efforts to reduce the
industrial related issues such as strike, legislations have been passed in an attempt to enhance the
relationship between employer and employees. This has led to the adoption of public sector
collective bargaining legislation which is aimed to minimize strikes caused by
misunderstandings between the employer and the employees in the public sector. However, these
legislations are not a sure way to solve all problems but rather to minimize. Studies show there is
a complex relationship between strikes in public sector and collective bargaining legislations.
Therefore, it can be concluded that there are other factors that influence the occurrence of strikes
other than legislations.
Arbitration act that has been addressed in the case study was passed in order to resolve
disputes that could not be resolved through negotiations. The act provided for a collective
bargain and the municipal authorities were supposed to consult and discuss in good faith. As it
has been revealed in the case study arbitration led to a strike in the police department. When the
city granted the arbitration, the resolutions of the arbitration panel were not binding to the
municipal authorities. At the same time the act had made the ruling of the panel binding to the
labor unions and penalties were provided for in the act if the authorities were not bargaining in
good faith.
However, the authorities refused to concur with the recommendations of the arbitration
panel and this was clear to the police that their demands could not be met and therefore, went on
strike. From the case study, it is apparent that arbitration does not solve all labor issues. The
police strike in Oklahoma City could have been avoided if the arbitration process was effectively
handled. Besides this, the arbitration could have been more efficient if the rulings made by the
