The due process is a requirement for most institutions because before they can deprive
some people of their rights, they have to follow some procedures. The due process clause is
meant to bring fairness to institutions and in this case in schools. In getting, fairness, a person can
be given a notice or they can be given meaningful time to defend themselves in a meaningful
way. Due process may also involve making decisions that are supported by substantial evidence.
The students’ rights stipulate that due process should be followed when they face suspension
from the school even after breaking the school rules. Also, case laws require students to be
accorded an informal hearing before and after they come out of detention. The aim of this is for
the students to understand why they were punished so that they will not repeat the mistake again.
Three aspects of due process for a school seeking to suspend a student with disabilities
A student that has been identified to have disabilities according to the individuals with
disabilities Act (IDEA) is liable for suspension as the other students that have no disabilities.
However, before the student can be suspended, some form of in-school intervention should be
used prior to the suspension. Also, the suspension should only be imposed when all the other
corrective measures that a school has used have failed and they have failed in bringing proper

conduct to the student. The first aspect that may be used by a school when suspending a student
with disabilities is using the 10-day suspension period while at the same time seeking parental
consent for another placement. Secondly, the school may use the county office to include
dangerous disabilities students in an individual Education Plan where the parents will give an
advance action for special disciplinary action. Thirdly, if the school decides to exclude the
disability student from the school bus transportation, then the school will have to provide an
alternative means of transportation.

public education in that it opened doors for all the students and many integrated schools were
formed as a result. Also, the decision has led to educational opportunities falling to the minorities
that were initially not able to take their children to school. Today, education has become an
important function of state and local governments and it has become compulsory for all children
to go to school and the great expenditures towards education prove that ("Brown V. Board of
Education"). Education has become one of the most important aspect that is required in the
performance of the most basic responsibilities such as in the armed forces.
