Situation 1
As a human resource manager, it is important to put into consideration the different
religious views of all employees. Religion in the workplace is among the most contentious and
difficult areas for employees and their employers to navigate. In the current increasingly diverse
and religiously pluralistic society, conflict is bound to occur. In this situation, the employees are
being asked to work on weekends, a directive that does not augur well with some of them
(Armstrong & Taylor, 2014). To begin with, religious freedom is a civil liberty enshrined in the
first Amendment to The United States Constitution. Making employees work on a day that they
consider a Sabbath is trampling on their right to worship and is not acceptable by the law, as
much as employers have a right to be served by their employees.
In this case, as a human resource professional, I would ask the employee to go through
his copy of the employment contract to confirm that he did no sign to work on weekends. This is
because the employer-employee relationship is governed by the contract signed at the beginning
of the employment relationship. If the employee did not sign for such a situation, the best thing
to do is confront the manager kindly about the situation to find a way they can sort out the issue
without so much drama. The employee could also organize for someone from another
department to stand in for him on the Sabbath and agree with the manager in charge if this is all
right. If all these options are denied then the employee can sue the employer for breach of
contract. If such a case is indeed included in the employment contract, the employee has no
option but to report to work on the Sabbath or risk being fired. However, they could organize
with the supervisor for a situation where the employee can be pardoned to report to work after
worship or hire someone else for that job on the Sabbath.
