Facts
During the oil crisis of 1973, the Public Service Commission of New York barred all
promotional advertisements from lowering consumption. This was because of the findings that
"the utility system of New York State does not have sufficient fuel stocks or sources of supply to
continue furnishing all customer demands for the 1973-1974 winter" (Boedecker, Morgan &
Wright,1995). This directive prevented usage of any material endorsing the usage of electricity
from advertising platforms leaving room for advertisements on informational drives. By 1976,
the oil embargo had reduced. Nevertheless, The Public Service Commission of New York in
February 1977 announced that it will uphold the prohibition on any advertising resources aimed
at making trades. The commission aimed to extend their protection energies as a way of reducing
uncontrolled advance of electricity usage and align the area with the plan by the national
government to conserve energy.
Legal Issues.
Central Hudson Gas and Electric Corporation filed a case against the Public Service
Commission of New York saying that they had infringed the First and Fourteenth Amendment
rights. The corporation claimed that the order limited their right to commercial speech.
