What is Systemic Discrimination?
Systemic discrimination is the application of policies and procedures that produce
discriminatory results. Balko (2019) refutes that this means that everyone involved in the
system is be racist or otherwise discriminatory against minorities. However, even with that in
mind the criminal justice system is still rigged with racist individuals.
A good example of systemic discrimination is clear when one compares between the
treatments of mass shooters. Recently, social media has been teeming with such comparisons.
A white mass shooter would be arrested and subjected to the letter of the law. A person of
color in the same situation would have been killed on site. Another good example of possibly
unintentional systemic discrimination is exemplified in the Arizona bill 1070. It prohibits any
alien older than 18 to be in the state of Arizona without legal documentation. The bill also
gives just cause to law enforcement to stop anyone they might think is an alien. The bill is
aimed at reducing the instances of illegal immigration in the state. However, it also
unintentionally encourages racial profiling.
Possible Reasons for High Minority Representation
The policies and procedures like the ones enforced by the Arizona bill 1070, first and
foremost are the reason for just a large representation of minorities in prisons and the courts.
Another reason for the large representation is the blatant racism that plagues the criminal
justice system as evident from the differences in treatment of different colored individuals
(Rocque, 2011). An example is evident from the statistics. A report o the UN revealed that
people of color were more likely to get arrested than their white counterparts. The same
applies to prosecution.
