Ans: Offence:
The Term “offence” has been defined in the code of
criminal procedure as any act or omission made
punishable by any law for the time being in force, it
also in clouds any act in respect of which a complaint
may be made under section 20 of the Cattle. Trespass.
Act, 1981.
The definition is wider than the definition of the same
term contained in S.40 of the Pakistan Penal Code
where under the word “offence” denotes a thing made
punishable by the Pakistan Penal Code.
Neglect to maintain one’s wife and children is not an
offence within the meaning of this sub-section and a
finding of a magistrate ordering a person to pay
ascertain amount of money for the maintenance of his
wife and children does not, therefore amount to a
conviction for an offence.
Similarly a person proceeded against under sec. 107.
109 or 110 of Cr. P.C. is not an accused.
