Goals of Sentencing
Sentencing involves imposing criminal sanctions on an individual, usually by a legal
authority such as a judge (Travis, 2017). The criminal justice system takes on the role of
sentencing in the U.S. there are four primary goals of sentencing. The first role is retribution,
where a person gets a similar punishment for the crimes that they have committed (Travis, 2017).
For instance, a person found guilty of murder may face the death penalty, which is equivalent to
what they inflicted on the victim. The other role is the incapacitation of the law offender. It
occurs by restraining the individual by removing them from society. Consequently, there is the
elimination of the chances of committing other crimes within the community.
The other goal of sentencing is deterrence. This is where the sentencing authority
exercises it in such a way that others will refrain from committing a similar crime due to the
intensity of the punishment (Travis, 2017). An example of deterrence is where the criminal is
subject to public humiliation. Sentencing also aims at rehabilitating the criminal. The criminal,
through sentencing, separates from the environment that initially made them commit a crime.
Thus, they have the chance to improve their behavior and become better persons in society.
There is also the goal of restoration where the sentencing authorities give the victims an active
role. There is usually a meeting between the victim and the offender to discuss the implications
of the crime. The offender then takes responsibility for their actions and maybe a way of
preventing them from engaging in such activities in the future.
The current criminal justice system reflects some of these goals to a certain degree (70%
from a personal perspective) such as deterrence, incapacitation, and rehabilitation. The criminal
justice system aims at developing an overall better society and therefore emphasizes these three
areas. When people go to prison, there is a higher percentage who transform while others engage
