1. Yes it is. People love to say it is "racism" that is the root cause of it, but actually there is a more obvious reason to that and it is due to high rate of crime by the Black Americans. Insisting that it is not, only worsens black alienation and only pulls us away from a real solution to the problem of black crime .

According to the federal Bureau of Justice Statistics, in 2005, the homicide rate by blacks was more than seven times higher than that of whites and Hispanics combined, .From 1976 to 2005, blacks committed more than 52% of all murders in America. Blacks also constituted 39.3% of all violence-related crimes, including 56.3% of all robberies and 34.5% of all aggravated-assault arrests, and 29.4% of all property-crime arrests.

Although it is still arguable that it is cause by a biased legal system, there is more evidence that it due to the high rates of black crime.

2.) Sociological Factors such as Poverty and Education could also be a factor. Since people who don't finish high school are more likely to get incarcerated. Poverty also disables someone to protect himself with a good quality of legal representation (e.g lawyer) and also makes it hard for them to pay for bail at all. Besides, the reason for most people convicted because of robbery is almost always poverty. 

 The use of Drugs and alcohol are also big factors, as most violent-related criminals are positive in using these substances. These substances also alters someone's state of mind or consciousness, leaving them more vulnerable to do criminal activities.

3.) These problems can be solved by improving the education system and lessen its costs. Educated people are less likely to do criminal activities, therefore if we make education reachable to everyone, this can prevent a lot of crimes in the future. 

Also, creating opportunities or opening more and more jobs can solve it, as most of those that get incarcerated are unemployed. Employers should also lessen or remove racial discrimination in picking an employee.

There should be more shelter for the homeless. As homeless people are also more likely to be incarcerated.

Drug rehabilitation centers should also be deployed in more areas and actively seek those who needs treatment. Some criminals who are addicted to substance should be sent to rehabilitation centers rather than in jail, or before sending them to jail to make sure they will be free of the drug. Do campaigns against drug abuse and also alcoholism.

Black Americans should not be excluded or discouraged in any of these.
