MGT520 SEU Performance Management Essay
Comparative systems and absolute systems are two types of systems that can be used to evaluate employee performance and competencies. As discussed in Chapter 5, there are advantages and disadvantages associated with these systems.
As the newly hired HR Director for a large manufacturing organization, which makes parts for cell phones, you have been informed that the current performance evaluation system that is utilized is almost nonexistent. In fact, it has been almost three years since employees have been assessed. You have been asked by upper level management to do the following:
Explain what type of performance evaluation system you would use to evaluate factory workers. Justify why you believe this is the right system to use.
Based upon the selected system, what assessment method would you utilize? Justify why you believe that this is a quality assessment method.
Explain how the selected system and method are aligned with or different than performance management practices in the manufacturing industry.

Stanford University ABC Company and XYZ Company Discussion
ABC Company has a contract to provide security services with XYZ Company. During the contract’s time period, most unionized guards go on strike, thereby making it impossible to fulfill the contract. Does XYZ Company have good cause to sue ABC Company for breach of contract? Why or why not? Add citation and references Do the discussion then do the response each posted below Posted 1 The elements of a contract include: offer, acceptance, consideration, legality, capacity, and mutuality. The terms and conditions are negotiated and agreed upon by the offeror, who proposes an agreement, and the offeree who is offered an agreement. The scenario lacks a few details, however we know the main purpose for the contract was to provide security services. Since the service wasn't performed within the contract's time period, it is breached. XYZ can sue as long as they fulfilled their part of the bargain. The company cannot sue ABC if the strike is a result of XYZ's failure to meet contract obligations. Posted 2 No, in this case XYZ Company would not have sufficient cause to sue ABC Company for breach of contract. There are different situations that can cause a discharge of duty to perform. In this scenario, it is stated that most of the unionized guards go on strike making it impossible to fulfill the contract. Therefore, this case falls under the discharge by operation of law as a discharge by impossibility or impracticability of performance. This occurs when it has become objectively impossible for the contract obligations to be completed (Wiley, 2022). Posted 3 This topic is difficult to discuss with the minimal details provided about the contract between ABC and XYZ. I think there are a few pieces that need to be discussed first. Did ABC know that there was a strike on the horizon when the contract was executed? If ABC had prior knowledge of an impending strike, then it may be reason for the contract to be void either way. Contracts can be voidable if there a mutual mistake involved, like both moving forward with the potential of a large workforce strike. “The standard for whether the mistake of fact is material is whether a reasonable person would have entered into the agreement if the true facts were known” (Gordon, 2021). ABC may also escape mostly unscathed if there is a clause included in the contract that allows them to void if an issue, like a strike or non-performance, occurs. The ABC Company would likely have an agreement in place with the union when the contract was agreed to that banned strikes during the contract period. If that agreement is not upheld, then I gather that the agreement for performance that is not fulfilled by ABC is cause for breach of contract. If a factory lost their employees to a strike, for whatever reason, they would likely have to shut down operations or hire workers to fill the gaps. The ABC company is no different in this respect and are still expected to provide security. Depending on the company and the goods being provided or made by XYZ, the lack of security could cause a large material problem. I think from a moral perspective, I would prefer the companies work something else out that protected them both. Potentially, voiding the contracting with ABC once the information of the strike came up and joining a contract with another similar company. This scenario would need to include substantially more information to make a reasonable suggestion about litigation or moving forward amicably.
