Title
VII of the Civil Rights Act of 1964 and the Americans with Disabilities
Act (ADA) cover all private employers, state and local governments, and
education institutions that employ 15 or more individuals. These laws
also cover private and public employment agencies, labor organizations,
and joint labor management committees controlling apprenticeship and
training.
An employment contract does not allow for or legalize any act of
discrimination that is covered by Title VII. A contract can not set as
an acceptable working environment any policy or procedure that tolerates
or promotes discrimination. So to answer your question YES Title VII
can and does override an illegal contract.
there are some exceptions to these laws for multi-national companies.
