All the justification defenses are exceptions to the rule of law. They allow individuals to take the law into their own hands. According to the rule of law, the government has a monopoly on the use of force. Use of force by individuals must be justified by law. The justification defense of consent recognizes the autonomy of the individual to engage in activities without interference from the government.

  • Should an individual be permitted to consent to possibly serious bodily injury as a result of participation in a sporting event such as football or boxing or ultra-violent wrestling?
