Description
Should the 1st Amendment Right of "free press" outweigh the 6th Amendment Right to a "fair and unbiased trial?", a brief discussion post 150 words
Explanation & Answer
Thank you for the opportunity to help you with your question!
The first amendment should outweigh the sixth amendment only in some situations. Both amendments are both vital pieces of legislation, and none should be assumed to be more important than the other. Therefore, determining which should outweigh the other should depend on the situation.. In cases where a free press would result in an unfair and biased trial then the sixth amendment should be invoked and the freedom of the press limited. .
Although the freedom of the press is guaranteed and important, it should not be used to deny citizens other freedoms that they are entitled to. If the first amendment was allowed to outweigh the sixth amendment then it might deny citizens the right to a fair and unbiased trial as guaranteed in the constitution. However, in cases where cause is shown that a free press would not result in an unfair or biased trial then the 1st amendment should outweigh the sixth amendment.
