Description

Assignment: Pick a freedom or right guaranteed in the United States Constitution that, based on course discussions and your opinion, seems smaller (or less free) than it used to be or in the alternative seems larger (or more expansive) than it used to be. Incorporate information from at least two (2) sources of information besides the text, as well as your own past experiences and observations, to support your opinion.

Length: 1,000 words-approximately 4 pages, (double-spaced in either Times New Roman 14-point font or Courier New 12-point font.)

Description: Freedoms are never stolen, they're gradually eroded. Recognizing how a freedom has been eroded is important, because often a freedom isn't noticed until it's gone. Alternatively, certain freedoms are expanded by judicial interpretations of the Constitution. Recognizing how rights and freedoms can expand and evolve is equally important to an understanding of the Constitution as a “living document.” In this assignment you will research and examine the evolution of individual rights and freedoms guaranteed in the United States Constitution and describe how one of those rights has either expanded or contracted.

In writing this assignment, you will apply the ideas presented in your sources to your specific subject in support of your proposition. Here are some potential rights and freedoms to consider when making your selection:

  • Freedom of Speech (Chapter 10)

  • Freedom of Association (Chapter 10)

  • Freedom of the Press (Chapter 10)

  • Freedom of Exercise of Religion (Chapter 11)

  • Right to Petition Government (Chapter 9)

  • Right to Bear Arms (Chapter 9)

  • Protection Against Government Taking Without Just Compensation (Chapter 12)

  • Right to a Speedy Trial (Chapter 14)

  • Right to Bail (Chapter 14)

  • Right to Confront Witnesses (Chapter 14)

  • Due Process Rights (Chapter 12)

  • The Right to Privacy (Chapter 12)

  • Reproductive Liberties (Chapter 12)

  • The Right to Die (Chapter 12)

  • Liberty and Human Sexuality (Chapter 12)

  • Economic Liberties (Chapter 12)

  • Equal Protection Rights (Chapter 13)

  • Right Against Search and Seizure (Chapter 14)

  • Right Against Self-Incrimination (Chapter 14)

  • Right to Counsel (Chapter 14)

  • Double Jeopardy Rights (Chapter 14)

  • Right to a Fair Trial (Chapter 14)

  • Right Against Cruel and Unusual Punishment (Chapter 14)

Requirements:  The following elements should be present in your submission in order to fully examine the topic:

1) What you think the framers of the Constitution intended to be protected under the Constitution regarding the freedom or right you have chosen - 20 points.

2) What you think was traditionally protected and how.  This should have a reference to the Supreme Court - how have they viewed this topic - 20 points.

3) How that has changed – in other words, what is protected now and does there seem to be any reason why it changed?  This should probably have a current events article or other reference that shows that there is a change.  Some people do have personal experiences, and that can be used - 20 points.

4) What you think should be done. Is this a good thing? There are often clashes between safety concerns and freedoms and one might be more important than the other. Or is this a bad thing? Is there something citizens should do to prevent further erosion or curtail further expansion? - 20 points.

5) This assignment should be typed. It must be spelled correctly and grammar should be correct. Points will be taken off for spelling and grammar – 10 points

6) A bibliography needs to be included.  (10 points)  It can include your text book, if you use it to illustrate your points. It also needs to include the sources other than your textbook that you used. Please use authoritative sources (this usually does not include Wikipedia) such as newspaper or magazine articles (it is fine if you get them off of the Internet, as long as they are from actual publications) or other books (the library has very nice books on many of these issues in the KF section on the north side of the lower stacks). If you do not know if your source is authoritative, please ask me (email is fine). If you do not know how to cite information, there are helpful websites that can assist you.  I do not care if you use MLA or APA, just be consistent.

Do not copy another article about erosion or expansion of freedoms. This needs to be in your own words and with your own thoughts.
